1. Use of Service
You agree to use the Service in compliance with all applicable laws and regulations, including but not limited to the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, CTIA guidelines, and all applicable carrier rules. You are solely responsible for the content of the messages you send and for ensuring that all recipients have lawfully provided valid opt-in consent.
2. Eligibility
You must be at least eighteen (18) years old or the legal age of majority in your jurisdiction to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements.
3. User Obligations
You agree that:
• You will obtain clear, documented, and verifiable consent before sending any marketing or informational text messages
• You will not use the platform for illegal, abusive, deceptive, or spamming activities
• You will not impersonate another individual or entity or misrepresent your identity or affiliation
4. Prohibited Content
You may not use the platform to send content that is:
• Pornographic, obscene, or sexually explicit
• Promoting illegal substances or unlawful activities
• Threatening, harassing, defamatory, or discriminatory
• In violation of carrier policies, CTIA guidelines, or applicable laws and regulations
5. Account Registration
To access certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information and to maintain the security of your login credentials. You are responsible for all activity that occurs under your account.
6. Fees & Billing
Use of the Service may be subject to subscription fees, usage-based fees, or other charges as outlined in your agreement, invoice, or dashboard. You agree to pay all applicable fees in a timely manner. Failure to make payment may result in suspension or termination of Service.
7. Message Delivery
We do not guarantee message delivery. Message delivery may be delayed or fail due to carrier restrictions, network issues, filtering, or end-user device settings. CartCapital LLC is not responsible for lost revenue, damages, or performance issues resulting from delivery failures.
8. Opt-Out Compliance
You must support standard opt-out keywords (including but not limited to STOP, UNSUBSCRIBE, and CANCEL) and immediately suppress contacts who request to opt out. Continued messaging after an opt-out request may result in immediate suspension or termination of your account.
9. Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or use the platform in a manner that may expose CartCapital LLC, carriers, or third parties to risk or liability.

11. Limitation of Liability
To the fullest extent permitted by law, CartCapital LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, business interruption, reputational harm, or data loss, arising out of or related to your use of the Service.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.
13. Changes to Terms
